huband could be drunk and kill someone


What is the name of your state? PA

I am concerned that my husband who has received a dui (got it in June 06) and is an alcoholic (was in rehab and attending, but fell off the wagon) could potentially drive drunk again and mame or kill someone. I am afraid that my assets and stake in the house (in both our names) could be named in the suit by the involved victims. What can I do to protect my assets (premarital and marrital) before this potential tradegy will occur? I am seeking counsel next week on a divorce, but this can take years and I want to protect myself asap. Any ideas?

Raise your liability limits on your auto insurance policy and get an umbrella policy.

These are questions for your Attorney not some website filled with unknown persons fo unknown backgrounds. This is too important an issue to leave to people (like myself) who's background and education you are unaware of.

Thanks to both. I agree I should seek counsel and I stated that I was going to, but I have found out quite a bit of helpful information on the Internet (it is just another tool). If I raise my automobile liability policy, could this send out a red flag to the insurance company? I am not sure if they are aware of his DUI (which of course, would affect both of our policies).

Insurance companies do not add or remove violations mid term. They will see the DUI when they order his driving record.

Lots of people carry heavy liability insurance. Rich people do because they are vulnerable to lawsuits. I know lawyers who are not terribly rich, but they carry excess liability or umbrella just because they have seen how the system works. You can't add it after he kills someone though; the time to add it is now. Having worked in PI law, I can tell you that if the insurance coverage is good enough, there is no need to go after personally held assets, which is cumbersome work that does not always end the way the plaintiff would hope.
