What is the name of your state (only U.S. law)? CT, my husband recently recieved his 3rd dui lucky for him his first was 10+ years ago and its considered his 2nd. he blew a .082 in the breathalyzer i was just wondering if he had any chance to stay out of jail; we have a 1 yr. old daughter and he signed himself up for alcohol classes & therapy. is it all just too little too late, or does he have a fighting chance

The mandatory minimum is 120 days (and up to two years) for the second offense PLUS probation PLUS 100 hours of community service PLUS three years license suspension and between $1000-4000 in fines (not counting costs). He won't get a license again without treatment and an interlock.
While the first offense fell off the radar as far as OFFENSE counting, the prior doesn't bode well for leniency.

He needs a lawyer.
