Hiring a lawyer is no guarantee of any reduction or of being found Not Guilty... especially if the case is that difficult to disprove.

Why don't you ask the lawyer?

The thing is, he has never been in any trouble before, his last traffic violation was back in 1983 for speeding, and when he got pulled over ya he had a breath test but never arrested.the police officer gave him a citiation and let him call a cab.

My response:

He sounds like such a lovely guy! Remember, a fool and his money are soon parted. Your husband is making you a fool.

you know... good people make mistakes too.if they say they don't, your a fool to believe them. if they make that mistake twice then they are just stupid. he hasnt made that mistake again. it was a costly mistake that he does not plan to do again.

It appears the lawyer laid an egg instead of representing your husband...Don't use him the next time or refer others his direction. The legal industry is is full of non-functional lawyers and all they seek is an easy buck$$$

That sounds like a pretty harsh sentence for a first time DUI, especially if he wasn't arrested on the spot, and he had a lawyer to try and fight it.

Though I'm not sure what you mean by "extreme dui"... I'm concluding that he was excessively over the limit.

I'm curious as to if an appeal was seeked, and if this was the appeal trial in which he was convicted. The timing sounds right - Almost a year minus a month and a half.

Regardless of the situation, it does sound like a costly mistake and thankfully he has learned from it.

Good luck to you and him!

He got 10 days in Jail, and $1200 in fines. That's not exactly what I'd call "harsh". The rest of the costs were his own attorney fees.

"SEEKED"?

Don't you mean "sought"?

Do you have ANY idea what you're talking about?

Curt, don't you realize that dfw_girl's trailer has four tires, and not just two?

I'm beginning to.

Not all of them are inflated to 32 psi, either.

I have often tried to advise people in here NOT to hire a lawyer in many cases. Unless you are damn certain that you are truly innocent, there's really little point. For first time DUI-ers, it's best to just take your lumps and spend your energy and brain cells on preventing this from ever happening again.

If you drink and drive, are arrested, blow over the legal limit, admit to having had drinks, have other witnesses including the cops' testimony, there's no point in fighting it. Unless you just like paying a lawyer thousands of dollars. The lawyer will almost always be glad to take the case, and take your money. He will do all the steps all along the way. But in the end, it is very possible that he will get for you the very penalties you could get for yourself. But unless you had absolutely nothing to drink and no chemicals in your blood, OR if you have a big extreme multiple offense, you don't have to hire a lawyer. What you have to do is accept that you did the crime and get started on the inevitable penalties.
