is there anything i can do since they dont know who did this to me?
my body i thought was all better but i have recently gained this back pain that cripples me from walking for hours at a time. also when i am able to walk i am hunched to the side and am in pain. i hope i have posted this under the right thread i do know it had to be a drunk driver because it was right after.

You Want To Know Who Should Pay Right?

What do you want to do, I am gonna assume sue for damages.

Unless they can find the driver of the car who hit you, prove it was he or she driving said vehicle, prove DUI, you are SOL, that is just the way it is.

Even if they do, then you gotta sue in Civil Court, for damages, etc, and that could take years.

It has been almost a year since this went down, which just makes it that much harder as the trail of evidence has gone real cold.

You can apply for disability, SSI, SSD, State Aid, but then is about it.

??

Original poster, please fill in some of the missing blanks.

I saw a number of cases with phantom drivers come through the doors of the personal injury law firms here in FL. We took some, were able to in some cases find the driver. It's a long-shot, but it can be done with the right resources. I would recommend finding a qualified certified trial lawyer in your area that specializes in personal injury cases. Most will work on contigency fees, meaning you pay them nothing until they collect for you and then they take a "cut".

Texas has a Crime Victims' Compensation Program:
Quote:
The Crime Victims’Compensation Program is administered by the Office of the Attorney General and is dedicated to ensuring that victims of violent crime are provided financial assistance for crime-related expenses that cannot be reimbursed by insurance or other sources.

The Crime Victims’ Compensation Program is “the payer of last resort” after primary sources of payment, such as health insurance, Medicaid, Medicare, auto insurance, or Texas Worker’s Compensation. CVC program staff assist applicants in coordinating the use of all available resources.

Claims may be approved for benefits up to a total of $50,000. Individuals who suffer total and permanent disability as a result of the crime may qualify for an additional $75,000, which may be used for specific and limited expenses, such as lost wages, prosthetics, rehabilitation or making a home accessible, depending upon the law in effect on the crime date.

The financial assistance may be limited or unavailable depending on laws in effect when the crime occurred and is dependent upon the applicant providing necessary and required documentation.

For More Information
In your community, contact your local law enforcement agency's Crime Victim Liaison or your prosecutor's Victim Assistance Coordinator.

Or e-mail:crimevictims@oag.state.tx.us or Call (800) 983-9933 or (512) 936-1200 (in Austin) or Fax: (512) 320-8270.
