IL First DUI


What is the name of your state? IL

Several weeks ago I was stopped in IL, given a filed sobriety test, then a field breathalyzer which registered .10

I was taken to the station then given what the officer referred to as the "official" breath analysis which came back .76...

As a result my license was not suspended...what are my options in court...I am about to consult a lawyer but would love to get some info from anyone who may be able to help...

As a result your driver's license was NOT suspended?

Are you sure your "official" result was .76 or did you mean .076?

it was .076...he said my license was not suspended becasue i cam in under the legal limit in the station...

I'm in kind of a daze about what my situation is...

I'm sure your BAC at the station was a 0.076, not .76. It's an easy mistake to make. That makes it obvious, and this will be used in the prosecution against you, that you were over the limit and impaired while driving the vehicle, then your alcohol level began its decline over time. I'd brace myself for and research the minimum penalties for a first time DUI in your state.

While it did come in under .08, I agree with BigMistakeFl, that you were over the limit while you were behind the wheel.
