| | | Illegal procedures on me all the time My incident happened in Washington State. Well after playing a card game at a friends house, I started driving toward my parents house because I was visiting them during Christmas break because I am in college and I will graduate in February. Well I started smoking cigarettes and my parents dont know that I started smoking so when I got into my car I sprayed some cologne on. When I got two miles away from my house, an off duty police officer pulled me over going 54 miles per hour on a 50 miles per hour road. The officer asked me why I had cologne and I told him that I didnt want my parents to notice the cigarette smell. The officer then called anotehr officer to come to the site and when the officer came onto the site. The police officer told the new officer that he smelled too much cologne on me and he thought I was covering something up. So the officer asked me if I was drinking or if I do any illegal drugs earlier and I replied "No" I dont do either. So the officer asked if they could serach my car so I let them. After searching my car they found nothing illegal or no alcohol. Then the officer asked me to perform some test so I got angry, but I did the test and passed them. Then the officer asked me to to take a breath test and I replied "No" because I havent done anything wrong and I wanted to go home. He arrested me and then when I got inside the vehicle the officer asked for my name. I got more upset because I am a Hispanic male that everyone time I get pulled over I am always accused of either smoking illegal drugs or drinking and I dont do either. So I know the procedure every time I get pulled over but this time the officer was taking things too far. When my dad picked me up from the police station, I asked him to smell me and he replied " I only smell cologne" The officer said he smelled alcohol. But the first officer that pulled me over said he only smelled cologne.
My comment is: I am getting charged for a DUI, because the officer made false claims that I didnt do so well on the test and I smelled like alcohol. My dad only smelled cologne and the first officer only smelled cologne. But the second officer put lies on the paper work. Every time I make a complaint when I get handcuffed but then let go, I am being told by the police station officers that the officers have probable cause to search me or to pull me over.
My quesiton is: How can I not be arrested when an officer lies on their report for probable cause? Can I keep a video camera in my car and video tape when a officer accuses me of something? I need help because everytime I go to court my trials are always being dismissed because of not enough evidence to find me guilty but I am getting tired of being accused of doing nothing wrong. I have been arrest seven years in a row, and when I say arrest. I mean an officer has put handcuffs on me.
I have been handcuffed twice for not having I.D. I have been arrested for having a presciption drug, but not having proof from a doctor that I should have the vicodin on me at the time of the arrest, but I went to court with the proof to show that I was innocent. I have been handcuffed three times because the officer said "He smelled marijuana on me" so the officer searched me or my car and found nothing. Then I even take a drug test the next day and give it to the police station and showing them that I dont do illegal drugs. Then this last incident of the DUI charged, I was fed up of the officer accusing me because I was arrested three times last year and I was tired of police officers of accusing of me being guilty of something.
I know I am Hispanic and I am being stereotyped all the time, but when will it end. I am going to get my Bachelor degree in February of this year and then I am going for my Master's degree. But every time I get handcuffed by an officer, it gives me no point of succeeding in life if I am getting arrested all the time. I believe I have some kind of curse on me because what else is the explanation of me being handcuffed all the time. My parents try to consult me all the time that life isn't fair, but when will my life be fair like everyone else.

| | | Breath Test Why didn't you take the breath test? You could have blown a 0.0 right there on the spot, and eliminated the alchohol issue. |

| | | The only reason The only reason I didnt take the breath test is because I am tired of taking the breath test every year, and I mean I take that test atleast twice a year. I have been to court eight times in my life of being accused of something, but all the time they have been "Dismmissed" because the officer didnt' have enough proof that I did anything illegal and because I proved that I was being stereotyped among other people. All the time I've been arrested on assumption. Can I take a lie detector and can the officer take a lie detector on what really happened the night I got arrested? Then I would prove that the officer was lying about his assumption of smelling alcohol on me. |

I used to get pulled over all the time (as a teen) and given sobriety tests. I am a white female. I wasn't on drugs or drinking; I just sucked at driving! Just trying to give you a different perspective...
If you were going over the speed limit, they did have probable cause to pull you over. As for assuming cologne meaning drugs or alcohol, I don't know. Some people take baths in that stuff.

| | | I still wouldnt understand for teen. As a teen getting pulled over, is like saying all red cars get pulled over. That is a whole different situation. If you are a terrible driver then that is another situation, but I am Hispanic and I see all my friends, brothers, and even my father get pulled over and accused of something. When I was growing up, our house got raided by police twice because they thought our house was a drug lab. Even though we were poor, even though we gave blood, urine, and took a lie detector toward the city so they can stop making "assumptions" that we are doing something wrong. I didn't choose to be Hispanic, I was born this way. If you are a woman, wouldnt you be tired of men, accusing all women of being only house mothers and not be people who can work. Didn't women wanted to be treated the same as men. Well I am Hispanic and I only want to be treated the same as a white man as well. That is why I dont want to have a child because I dont want my son or daughter to be a "Victim." You must be in my shoes in order to understand my life, YOU must see the looks I see when I go inside a store, inside a bank, inside a new person's house, or even when I date a white women. I never did anything wrong in this world, but in people's minds I am already assumed of being a criminal! So should I carry a video camera every where I go, so the next time I get "assumed of an illegal crime" I will show my view of the world. |

| | | give me a break sheesh. i been riding non jap motorcycles since the mid 70's and you want to talk about getting harrased. lets see i came out of my door one day, my bike was in my yard idling, i was getting ready to go for a ride and was warming up my 67 BSA. i had my helmet on leathers on locking my door when i turned around theres a cop sitting there. first he gave me a ticket for reckless driving, mind you i had not even been out of the yard, then he tried giving me a ticket for tampering with the frame numbers, in 1967 BSA hid the frame numbers behind an exhust mount instead of on the neck. then he tried giving me a ticket for loud exhust, i had stock pipes and mufflers on the bike, 1967 standards, this was in 84. i beat every ticket he wrote me. after that any time me and the guys i rode with started getting pulled over for things like doing over 35 mph without eye protection, we all had sun glasses on btw. none of us drank while riding cycles but would drop into bars to play pool, leave the bar and get stopped. was that harassment yep, but we were smart enough to do as asked and gave them no problems, after 10 years of this stuff they left us alone. mind you when pulled over on a cycle even if your alone count on at least 4 cop cars to pull up right after. we found this all very amusing and went out of our way to be legal. | |
