My question involves criminal law for the state of: California

To make this simple, One was charged with a 'wet and reckless' at the age of 17 in 2009:
1year License suspended and $250 fee.

Move to 2011 age 19 same county
one was charged with DUI ( 23152 (A)VC )
blew .028, Believed to been breathalyzed at Peak.
Jail for night, bail.

Question. Will the recent DUI be charged as a first offense or second as the first happened when one was a minor.
i know the DMV will take it as the second, but im more concerned about court side.
Bail amount was $2500, was told thats the amount for a first offense DUI charge. Confused....

Also Under 21 is one eligible for restricted for work as its Not just a license but a career

please serious answers only. one learned lesson after jail visit.

There is no great difference between a first and second DUI as far as booking goes, that's why the low bail exists.

The DA can file the prior and make this a second DUI, but that won't be known until much later.
