impaired drivers kill my friend


Sorry about posting this question here, but this is the closest forum that I can find.

It was at Queens, New York last Sunday night. My friend Sean age 24 was going out to MCdonald to get his dinner, on his way back, an unlicenced Hispanic lady driving a SUV going through the oppsite direction of an one way street. After hittin Sean on the side walk, she crush into a passing over car. Sean was sandwished in between. 3 hours later, he died.

The lady claim she had epilepsy so that the police release her the following day without needing to pay bail.

The question is, does that mean she is free of any criminal charges. Is impaired driver free of manslaughter charge?

She was probably unlicensed because she could not get medical clearance to drive. She will most likely be charged with some level of involuntary manslaughter. Depending on the extenuating circumstances, if found guilty, she could get probation to just a few years in jail. Sean's family needs some quality attorney assistance and should get it soon. Unfortunately, things like this happen in todays society.

I think racer72 did a pretty good job in responding to your question. However, if you didn't know already, there is a difference between a criminal case and a civil case. Racer was referring to a criminal case. He mentioned that the driver may be charged with manslaughter. Maybe. Regardless of what happens criminally, the driver could have a civil suit filed against him. This means that certain persons on the victims behalf may sue if they believe that the victim was killed in a negligent manner. I don't know what the circumstances were, so I certainly don't know whether this is the case. I just want to point out that reparations can be made outside the criminal forum.

I do not think the my friend's family are able to get much out from the civil law suit. After all, this is New York. full of alians. I guess all she need to do is leave the town and go back to her country.

What puzzles me is will there be a criminal case. Correct me if I am wrong. As for my understanding, if DA release the person without needing bail, it means DA will not press charge on her.
