Interesting CO DUI


What is the name of your state? Colorado

This may seem strange but it is all true, no reason to lie here. Let me thank you ahead of time for reading this lengthy story!

On May 1st about 10:40 p.m. I was leaving my girlfriends house. She had baked me some scones that night that I had in the car with me. On my way home I got one out to eat it. While holding it it dropped and I took my eyes off the road for a second when the road curved to the right a little bit then went straight causing me to be half way in the left lane for a split second. When this occured and I got back into the right land (this was on a 2 way road) I saw police lights behind me. Once i pulled over the police officer approached my vehicle and took my license and registration and asked me how much I've had to drink, I said "none" (which was true). He then asked me "how much dope have you been smoking" yet again, none. He went back to his car for a good ten to fifteen minutes. After that two more cops showed up (a sheriff and a trainee). They said that they believed I was under the influence of marajuana so they asked me to step out of my car. Keep in mind I'm 18 years old and incredibly nervous so my legs were really shaky. I could pass all the mental tests and the finger to nose test etc. but when it came to the walk a straight line I stumbled once so they assumed that the action definetly meant I was high. They then arreasted me and put me in the cop car without reading me my Miranda rights (is that illegal?). They take me to the station and interview me and interrogate me (still havn't heard my Miranda rights yet) and called in a specialist to determine if I was on Marajuana. Well the specialist said my eyes were a little dialated and my pulse that he took three times was 86-104-86 so I'm nervous so therefore I'm high. Then I voluntairly took a urine sample because I wouldn't admit to taking any drugs, marajuana included. I've never smoked weed in my life, ever so I'm not afraid about that coming back positive. By this time they book me in for a CRS 42-4-1301 code 800 "drove vehicle when under the influence of alchohol or drugs or both". They took my picture, prints, everything. They then let me call my dad to come get me. Today (May 2nd) I went and picked up my car etc. because they gave me my license back. I asked the police officer who took gave me my ticket about the court date and my urine test. He said that even if it comes back negative I HAVE to show up to court on June 18th even though they said they should get the test in about a week (May 8-10ish I'd guess). Now, I'm wondering, am I really in danger here? I know the test will be negative and they didn't find anything in my car, no bong not even cirgarettes so there is no evidence against me.

Any help is much appriciated. Thanks in advance.

You have a court date. Show up for it or get in far more trouble.

If the results come back negative, you may find that the case gets dropped for lack of evidence before your court date. Contact the court house to see if your court date is changed or the case is dropped.

If it isn't dropped soon, plan on getting a lawyer.

Same DUI in CO


The same lame sh*t happened to me and I have never smoked pot. I got the exact same dui as you in CO. The officer told me the results would come back in 2-3 weeks but they took 4 months. They came back after my first court appearance. The case was dropped on a lack of evidence. Also happened to me when I just turned 18 and my record is completely f**cked as I've been denied to transfer colleges b/c of the arrest.

If I was you I wouldn't worry much about the case (just talk to the DA about your case when you get the urine results and he will drop it) as much as your life being f**cked b/c the arrest on your record.

Does anyone know if I can get the money back for my car being impounded?

Colorado has quite liberal expungment for dismissed charges, juvenile offenses, and DUIs. You should look into that .
