jail time for DUI in parked car?

Hello,

I live in Montgomery County, Maryland. A couple days ago i was arrested for DUI in a parked car with the engine running. I was asleep with my head on the wheel legally parked in a parking lot. My BAC was .14 when i took the breath test. This is my first offense, although several months ago i did get a ticket for having an open container while operating a vehicle.

At first I thought there was no way I could go to jail since I wasn't ever driving and it's my first offense, but now i'm not so sure. Is my fear legitament? If so, any suggestions of anything I can do in the meantime other than contact a lawyer? Any opinion is welcome, THANKYOU.

You were in control of a vehicle. Whether it was moving or not is not material and isn't even a mitigating factor. Other than abstaining, what you should be doing is consulting with a lawyer. There is no "what do I do before I talk to the lawyer. Call one today. They will tell you what makes sense to do next.
