juvenile dui blew a .038


What is the name of your state (only U.S. law)? south dakota.

hey, i golt pulled over, and i had 4 beers at 6 in the afternoon, and got pulled over at 11 for speeding.

i am 17 so i got charged with a dui.
i blew a .038, so do you think i could try a plea for dropping it down to an mic?
the first breathlyzer he gave me i think i passed, but he wouldnt let me see it. he then had me do a whole buncha field sobrity tests that i passed easy(good balance from football)

legal limit to drive if you are 21 is .08, so obviously i was not impaired to drive, granted i am a minor, so do you think i could somehow plea?? i cant afford a lawyer.

First vandalism, then shoplifting and now underage drinking - can you see the progression...can you see where you are headed???

Do us a favor Jordan, seeing since you don't know how to behave please don't come back here and ask for "How-to-beat-a-burglary-rap question a few months from now because you are certainly heading in that direction.

If you think we have no sympathy for you know...just wait until your next run in with the law. Fortuntately for you this time it seems like you may just get another slap on the wrist. I personally think you spending some time in a 6x8 cell with a guy named Buba might do you a world of good

if you actually read my posts, you would read they questioned me about it, and since i was innocent, nothing happened... so theres no vandalism.... the shoplifting,,, hows that have to do with a dui??? it doesnt.

please dont come to south dakota, because we dont want any know it all to good for everyone else


so if anyone that will actually help, and not be a post count junky, thanks.. if not dont bother

If you truly cannot afford a lawyer see if you qualify for a PD. I really don't see the prosecutor willing to cut a deal, but you never know. You were speeding and in most states a bac over .01 is a dui for a minor - you were way over that. The prosecutor has his case already made. Going in without and attorney and hoping to cut a deal would probably not work out for you. If you get an attorney the prosecutor will at least see that you take the situation and charges seriously (which is a must).

Wow... you admit to stealing a zune... you probably egged a car... and now you're drinking and driving? You're a winner! I have to agree with wireless... as long as you stay in South Dakota I'll have something to smile about tonight when I get off of work

On a side note, I'm officially starting a pool to see what this kid does next. My money is on some sort of drug charge. Any takers?

5 bucks on burglary...he's already admitted to sticky fingers. I think the odds are in my favor and against his.

Oh, the deck is already decidedly stacked against him. I don't know though, he seems to not (at least admittedly) commit the same crime twice, so I think I have a shot at winning the pool

yea, if anything goes missing from your house call me.. u might be up 5 bucks but out a house...

Jordan, what is the actual statute(s) that you were charged with? If you post that up I will research the wording of the statute and post it up tomorrow. Knowing the actual wording of the statute that you are charged with is one of the most important aspects of any police encounter. On a side note, this is definitely something that you should speak with an experienced attorney about. If you are unable to afford an attorney then contact your local courthouse and ask to be directed to the office that can help you obtain a Public Defender.
