is this lawyer doing everything he can?


What is the name of your state? Texas

my husband got pulled over for a dwi and was arrested after only 4 min. of the officer pulling him over. he was not drunk and after getting the tape he proved that he was of sound mind and did not show any signs physically of being drunk. the police report also is completely different from the tape. the lawyer said that the officer was supposed to observe him for 15 min. before arresting him and on top of that he had no reason to arrest him after the road side test were given. he was given a breathalizer in jail and it showed that he blew over. he had only 2 beers which had been 3-4 hours earlier. i heard that others arrested throughout the night blew in the same machine and could effect others results. is this true and why hasnt the lawyer done anything. my husband also worked around certain chemicals that the lawyer said could alter the machine. it has been a year and his lawyer is saying that he should either plead guilty or take it to trial which we dont have the money to do. is he doing everyhting he can?

Either plead guilty or take it to trial seems like good advice to me. Your husband had exactly the same amount to drink as everybody else ever busted for drunk driving, two beers. Next time he blows he should first eat two breath mints and be sucking on a 9 volt battery, that will counteract the chemicals he works with.

"If you can't afford an attornery, one will be provided for you..." If the state is charging your husband and you can't afford an adequate defense... get a public defender.

Also, if you're worried your lawyer isn't doing enough--then you should probably ask him why... if he won't tell you, get a new lawyer.

The lawyer gave you the option of beating the case at trial, what else are you expecting? What did he say you'd have to pread guilty to?
