Losing DMV points?What is the name of your state? Pennsylvania ***This is my fourth question posted after my first (and what will be only) DUI arrest in November. Although people have told me my case is "minor" compared to many others', I still feel ashamed and guilty, and look forward to encouraging others that driving -- even after moderate drinking -- is not good. To that end, thanks to those who have replied to my silly questions with honest, practical advice. Question: In Pennsylvania, if I'm accepted into the ARD program (ungraded misdemeanor), will this cause points to be added to my license? I currently have points from a couple speeding tickets and any more would put me over the limit. |

DependsIt would depend on how PA handles it. Where I"m at, you can enter "diversion" which is your ARD I believe, but the DUI is on your record for 1 year then it drops off. Insurance companies check your record every 3 to 5 years. If PA says the DUI is on your record for a certain time, then it's possible your insurance company could find out about it. If ARD means the DUI doesn't go on your DMV and/or criminal record, then it's likely your insurance company will never know about it. Sr22 isn't that freaky. Most state mandate that non-owner and non-operator Sr22 is available. You can get a non-operator SR22 for a fraction of regular Sr22 cost. The SR22 requirement is stupid because most people carry more coverage than the state mandatory minimums. Why go from more coverage to less? |

| There are no points associated with DUI. The conviction will be recorded on your driving record, as well as the subsequent license suspension. If you enter the ARD program, after completing all the required actions (pay fines, costs, probation, classes, etc) you can petition the court to have the offense expunged. I honestly do not know if PennDOT will remove the conviction from your driving record upon expungement. You owuld have to ask your attorney, or contact PennDOT.
