Lost the blow results


What is the name of your state? California

My husband hit a curb and wrecked his car and when the police came out they thought he was drunk. At the scene they gave him the breathe test. He asked for the blood test but they refused to give it to him. They took him down to the station and put him in a holding cell with no further tests. Then they lost the test results of what he blew at the scene. Their report said one number and what they turned in to DMV had a different number. How can they convict him without any proof?

Your husband will not be convicted if the state lost a proof of test result. The state MIGHT offer him a deal, but say NO, so the state will admit that it lost.
