Maryland DUI


Maryland

Arrested for DUI.

On form DR-15A the space that says "Order of Suspension: Issue Date
was left blank by the officer. Do I understand the Maryland Transpaortation Code § 16-205.1(b)(3)(ii) when it says that to mean because he didn't put a date there, that the officer has failed to serve the order of suspension? What are my chances of arguing this at the MVA?

We're going to need a few more details than that.

Was there a breath test, or a blood draw, or did you refuse?

Stopped at 0235 am returning home from a disc jockey job I was performing. Officer stopped me because as I was turning off of a major highway onto a side road, my left front tire "cut" the yellow line, according to the officer. There was no swerving or speeding or anything. I had 4 beers that entire evening (3.5 hour time period). Refused FST, as I could never do that stuff. Blew a .11 at the station. I was not intoxicated. I have been performing in night clubs and bars for 23 years and have never driven impaired. I have never been arrested for a DUI and I don't have any traffic violations with the exception of a couple of speeding tickets over a 25 year period. I have documented (in medical record) severe acid reflux and I believe this to be the culprit. I chew rolaids like there's no tomorrow. Don't take this as making excuses because my past driving history tells the story. It is not illegal to drink and drive, just illegal to drink more than the legal limit and drive. BTW I'm 41 years old.
