Maybe case drop ?What is the name of your state? Ca i went to court today and my name is not on the list. I ask the clerk and he said try to call in once week to see if they set a new court date for me, also i called to check my alcohol level but they didnt have it yet ( maybe they dont have the evidence agaisnt me ?). I wonder how often they drop a dui case ? cuz my friend said if they dont send u any mail or setup a new court date in a year , probably they'll let u go ? May I ask where is your court in CA? Similar case here [look at my thread (title: Delay in ourt hearing?)]. My attorney can't find my name in the court calendar on Tuesday and the court hasn't filed the charge yet. He is checking with DMV regarding my license status because it has been expired already but we receive no word from DMV either. The attorney just ask me to check out the mailbox. If the court file the charge, they will send me a mail with the court date. Same thing with the DMV hearing too.. they have a year to do it or the case will be dismissed. My attorney told me the court (Pleasanton, CA) is very short-handed and it might be the case... |

| They're not "dropped" very often. |

| Buy a lottery ticket. You will have better odds than having your case dropped.

| It's not unusual for the Prosecutor to fall behind in filing - they have one year to file charges. If it was a blood or urine (drugs) test, then the lab takes a few weeks to respond. The labs are frequently behind in their analysis, and will do felonies first. |
