KY DUI, control of vehicle defined

Kentucky... My son was arrested for sitting in the driver's seat, engine off, keys in his pant's pocket. Drinking with friends at local bar, buddy drove him to a friends house.. Sitting in car with friend smoking... Did not drive car.. Elderly neighbor call police because they were not familiar with my son's car. Police smelled marijuana, called for drug dogs, no drugs.. arrested son for DUI, son refused test... Buddy arrested for public intoxication. First offense .. son is 22. Any thoughts on "having control of vehicle"?? Vehicle was in shop that morning and it was determined that it was not safe to drive because the side walls of the tires were defective. Police observed all the tires in the back seat of the car... Help !!!
