Military Member With a Civilan DUI Charge


What is the name of your state? Virgina...I am a military memeber in the Air Force. I am facing a DWI charge( have not been convicted)first offense. I did a PBT but it read inconclusive...i then went down to the station and blew an "invalid sample" and they said that that constituted as a refusal....so i was giving a court date(this friday)and I was wondering what all do i need to expect in this situation will i be procsecuted by the military and the civilain court.....I need help ASAP

The refusal will GENERALLY result in a year's suspension of your license.

Yes

Inform your NCOIC immediately

You will most likely receive an Article 15, maybe loss of rank, restriction, and extra duty. In some cases a Secueity Clearance can be revoked

Depending on your track record in the airforce, your CO might suspend any punishment he gives you..unless you have been article 15'd before? Also if you beat the charges out in town, it will be tough for him to get you under articles 111 & 92 (dui and failure to obey a lawful order). Get a lawyer! If you beat it out in town and the af tries to NJP you, take it to court martial..with a lawyer. I'm in the same boat right now with the navy..they are trying to NJP me before I even get a guilty/not guilty verdict at trial...f'd up but they are allowed to do that now.
