Minor Consumption, breathalyzers while passenger in carWhat is the name of your state? Minnesota This past weekend I went to a formal and was drinking. When it was over, we had a sober driver to drive us home. We were pulled over on accounts to speeding and the driver was given a sobriety test which she blew zeros. The officer proceeded to give everyone in the car breathalyzers because he said it was safe and sober weekend and everyone in the car was required to take the breathalyzer. Therefore, I received a ticket for Minor Consumption while in the back seat of the car. Was it really required for everyone to take the breathalyzer and is there anyway I can get this ticket erased from my record???? |

| A car carrying three underage drunks tends to smell pretty bad. The smell alone gave him probable cause to determine if any laws were being broken, which you admit they were. IMO, since you all consented to a PBT, you provided the state with their entire case.
