minor dui


What is the name of your state?Texas

I got a dui last night and blew a .08 on the breathalizer. I was pulled over going 48 in a 40. I received a DUI and the officer said that it was a class c misdemeanor and he didn't know what the judge would say. I'm 20 and will be 21 in May. The speeding part he just wrote as a warning. So now i'm wondering what will happen? Will my license have to be suspended, will I have community service, will I have to go to classes, and mostly will this ever be able to be removed off my record? I looked into this a little and saw something about getting it deferred, but how does that work too? ... Please help

Ok, so now the officer called me back last night (wed) at 11pm asking me to come up to the station because he forgot to give me some paperwork. My boyfriend rode with me and before we got there decided it was probably best I didn't go. I called the officer back telling him that I couldn't make it and could he just leave the paper that I coulc come and sign it tomorrow. He said no, because he was going to need to get my license from me and confinscate it and send it to Austin and that he had forgot I needed to sign the paper the other night. So, basically he messed up. Am I going to get in more trouble if I don't go? I already have a court date set for the 17th and shouldn't the judge be the one to suspend my license?

The law requires that the officers seize your license on the spot and then you have to have a hearing with your DMV to retain it.

Yes, it sounds like he messed up. However, NOT getting that paperwork won't prevent a suspension from occurring, it may just prevent you from getting the information you need to obtain a hearing.

It might be best to consult an attorney as to what the options might be.

I dunno ... TX law is different from CA law on the subject, so I couldn't say for sure. But, it's likely to be suspended until you take action to get it back.

Call the DMV and ask them how to get the license re-instated.
