Minor in possession of alcohol


What is the name of your state?What is the name of your state? Washington State.

My son was a passenger in a car driven by his friend. The car was stopped for speeding and the driver charged with DWI. They were in Kittitas County. My son was 17 at the time and was charged with minor in possession of alcohol. Recently I learned that minor in possession of alcohol, when the person is under 18, is a felony. But if he had been 18 to 20 yrs old it would have been a misdemeanor. Is there anything that can be done to have this felony removed from his record.

Give us the statute number your son was convicted under. (It's on his court papers on the kitchen table.)

Whoever told you MIP is a felony for those under 18 is incorrect. RCW66.44.270 is a gross misdemeanor for everyone under the age of 21.
