Need DUI help for Missouri resident


I have an attorney, but I cannot get hold of him as he is out of the office until next week. My hearing for probable cause is stayed, but I need to rent a vehicle for work. Can I go to the DMV and get another hard copy of my license since there is no conviction or hearing as of yet? They gave me a 15 day temp piece of paper, but that 15 days is long gone and I need a photo license. Any suggestions? I have to tell my boss something first thing in the morning. Just found out about the need for a vehicle at work today.

Did you apply for the administrative hearing within the 15 day limit? This is different than the probable cause (criminal) proceedings. If you didn't you are in a world of hurt now to get your license back regardless of what happens in criminal court. You'll need to wait out the suspension period, retake the license tests, file an SR-22, and show completion of the substance abuse class.
After 30 days you can apply for restricted privileges.

Yes, I did file - my atty did anyhow. It is scheduled for Oct. 21. It was stayed according to DOR, and then I received a letter from them saying Oct 21 for probable cause hearing.

From my experience, if your DMV considers your license suspended, even if temp pending outcome of anything, no car rental agency is going to rent you a vehicle. I had to make other arrangements when I traveled for business.

You are suspended until the hearing restores your license. "Probable Cause" is confusing, that's a step in the criminal trial, the admin action doesn't need to determine probable cause, and it's a one-swell-foop hearing, they'll decide right then and there. Your option after that is to appeal to a real court.

Sucks!


I appreciate all the feedback. I was up for a nice promotion as the company is expanding. Damn. You know, we lost a child last year, and my wife gave birth again one year later. We went out with another couple for dinner and drinks - first time in 3 years. Just happened to be a DUI checkpoint set up just right that there is no place to escape and I got caught. Blew a .09, too. Well, if anyone comes up with any ideas before I tell my boss, let me know!!
