Need help. probation violation


What is the name of your state? CA
I just recieved a warrant for my arrest in the mail yesterday. I have a first offense DUI. I had my public defender file an extension so I could finish the alcohol program, which I have not finished. I am going to turn myself in, but I am scared of going to jail again. Is there any chance that I won't go to jail? Please help

Now might be a good time to buy 500 Shares of K-Y Jelly, Corporation.

I understand Big Bubba buys quite a bit of K-Y Jelly for his own personal use, and you could be rich when you get out of prison. Of course, most of the K-Y Jelly will be used on you! So, since you're going to get poked by Big Bubba anyway, you may as well make a profit!

There is always a chance you won't go to jail. However, the odds are that you will have to at least spend a couple of days in custody until you are seen by a judge again. At that point, a judge MIGHT see that you are attempting to take care of the problem (if you are and can demonstrate this) and you might be able to remain out of full time custody. Many counties provide a number of options to incarcerating DUI drivers - your attorney should be able to tell you what your most likely punishment(s) will be.

Bench warrant not Arrest warrant


I guess I should have specified that is was a bench warrant and not an arrest warrant. I spoke w/ my PD today and she said that if i come in to court and turn myself in, that it would be highly unlikely for them to send me to jail. i have a good case. Its my first offense, i am a full time student, I get good grades and I've been working 2 jobs since my initial DUI arrest. hopefully the judge will see that I am a good hardworking girl. Lord knows, i will never drink and drive again.

A bench warrant IS an arrest warrant. if the served you notice requesting you turn yourself in by a specific date, then the warrant had been stayed.

Bench warrants are not always capable of being served in counties where there are overcrowded jails, but in many other counties we will serve them like candy.

You are likely right that you will not serve time. But, depending on the system where you are, don't be surprised if you DO have to spend a couple days in custody prior to seeing a judge. There are times when the court is backed up too far to see someone turning themselves in a bench warrant that is "off calendar". If your attorney can calendar your case you stand a better chance of avoiding that initial stay ... unless the judge doesn't like the odds of your actually returning later on without making bail.

Jail..


First time DUI offenders usually get only 48 hrs. in jail. SUCK IT UP.
