No breathalyzer was offered


What is the name of your state? Georgia is where I am from. I was wondering if a dui will stand in court even if there was no test offered toi me too see how much I had. The ticket is down as DUI/ALCOHOL (less safe). I did not spend the required time in drunk tank( holding cell) for the arrest either. My license were returned to me as though nothing was wrong and I was sent on my way. I was on the side of the road changing a flat tire when the officer pulled up behind me, while in transport with another person. So I was wondering how a dui can still be given.

Hi. DUI is evlovling to where BAC isn't going to matter. They're going to come up with muliple 'levels" of charges for being around a vehicle after comsuming alcohol whether you've driven or not. Gas prices are high, and they need some way to pay for it. Keep that in mind the next time you decide to order a drink outside of your home. An article in in my next door state's paper spilled the beans that they are stepping up efforts to write tickets to get money to pay for gas. There's probably a few details in your situation you haven't disclosed, but you did the right thing by getting transportation home which is my impression of what you said.

Definitely sounds peculiar, like either some vital parts of the stop / arrest were missing, or vital parts of the story are. Can you fill in some blanks?
