no keys in the ignition

I got a dui in a convenience store parking lot. The keys weren't in the ignition and no one was even in the drivers seat. The cops were called because I threw an onion at a sign and I wasn't even driving but I took the blame because it was my fault that the cops go called. Need to know if I can get dismissed. I am in California.
