no record of b.a.c


i am being charged with dui i went to get my bac blood results from the lab and they told me they had no record of such a test. i live in tn this happened in sept. my court date is in jan. the da has not recieved these results either i was just wondering how this could effect my case.

It depends. Did you do a field sobriety test? Was it videotaped?

The officer who arrested you will testify that you were under the influence.

The case will most likely be continued for 30-60 days to allow for the lab to process the reports. The state can theoritically continue the case for up to one year before they are in violation of the speedy trial notion.
