NY Unique DUI Case


What is the name of your state (only U.S. law)? New York

New York - I was drinking and took an ambien - blacked out. NO MEMORY.. But here is how the story goes.. Rode Bicycle to my local bar - a big proponent of no drinking and driving.. (even INITIALLY in my black out).

Bartender calls 911 because I was out of control. Ripped off shirt and challenging people to arm wrestling. Cops arrive. Send me home riding my bicycle - clearly severely intoxicated (I think I fell because scrapes on face)

My wife told me I was hallucinating and irate.. Still blacked out somehow drove to bar and parked in front (No MEMORY).. Cops called again.. Escorted me out and sent me walking home. Clearly intoxicated and causing a lot of problems.

Not sure how far I went but I returned to bar. Cops called again - let me go again - clearly severely intoxicated. I went to car - got in drivers seat put key in ignition and was arrested. Don't remember anything - Blew a .21 - charged with aggravated DWI. I Remember bits and pieces in police station - cops laughing.. Refused to sign breathalizer.

Cops even wrote on report that 911 call to bar and sent patron home on Bike.. How crappy is that..

The cops were village cops and were trying to "do me a favor" by not arresting me.. Some favor...

Thank God I didn't hurt anyone - if I did - cops would certainly be in trouble..

Not proud - embarassed and upset.. Went to Detox and started intensive outpatient Drug and Alcohol Education Program.

Do I go to trial???

Do I bring civil case against cops?

That I call a near-death experience, which, I know, can be considered a misuse of the phrase. I had one on the very same drug combination before I stopped drinking--though no police were involved and I was only in a brown out, where I had sporadic and short-lived memory loss. I had useful memory but YOU DO NOT--as you implied.

That you have no useful memory means--so it seems--that you will have to rely exclusively on witness and police reports.

In my opinion, that the several police incidents did NOT result in the end of this obvious danger to yourself and all others in your path is criminal or, at least, negligent. (I don't think that the police violated any laws.)

What many people don't know is that when ONLY alcohol is involved, only SOME of one's inhibitions are lowered or removed and that it requires (for most) a whole lot of alcohol for a COMPLETE removal of inhibitions. When drugs like Ambien or any painkillers are added, it takes MUCH LESS alcohol to have complete and total loss of inhibition. This is the most dangerous state that I have experienced.

What's not completely clear to me in your story is where your car was when you, "went to car - got in drivers seat": Did you drive your car to the bar prior to the 2nd and 3rd releases by the police?
