Ohio DUI law


What is the name of your state (only U.S. law)? Ohio

A friend of mine was seriously injured from an auto accident he caused in 2007 while intoxicated. He was unconsious at the scene, and woke up weeks later in the hospital. He was never formally charged with a DUI, but during his three months in the hospital the police made periodic visits to his home residence. They advised that they were wondering how he was doing. He has made a miraculous recovery and has been given approval to obtain a drivers license again. He is worried about getting his license because he thinks that the police were really visiting his residence when he was in the hospital to arrest him for DUI. He thinks that when he gets his license back he will be arrested. He has mentioned that he thinks there is a two-year statute of limitations for DUI in OH; therefore, he needs to wait till after the two-year anniversary of the accident to get his license back.

Can anyone confirm this idea, or advise differently?

Did they take his license away? Or did it just expire?
Did they take his blood and send it to the lab to have his BAC tested?
How does he know he was intoxicated?

I don't know how long they have to charge him. Maybe it would be wise to move out of state to get his next license???

What was your BAC at the time of the wreck?

I believe they took his license away. We assume they got lab results from the hospital. We don't know what the results were, but he's certain he was intoxicated to some extent.

License


Getting a license in another state will not help him. He may have what appears to be a "valid" license in his wallet, but once suspended in Ohio, the other states will follow and he would be driving with a suspended license.
