Out of state DUI?

What is the name of your state (only U.S. law)? Virginia

I have a friend that was involved in an accident with a drunk driver. The drunk driver was taken out-of-state to a hospital in North Carolina. Now, the VA Commonwealth Attorney wants to charge the drunk driver with a DUI, but they cannot get the NC hospital to honor their suponea for his blood alcohol. What is the deal with this?!?! How can(why would) a hospital not comply with a court order for information relating to a criminal offense?What is the name of your state (only U.S. law)?

Disclosure of medical records is not by choice of the hospital. There are very strict laws that they must follow, and may not recognise Va's reguest.
I guess that it is also possible that they do not have legal BAC test results and may not have even sent blood to an aproved lab for testing within the time frame.
