OWI- controlled substance

What is the name of your state? Wisconsin


My son was arrested for OWI (controlled substance,marijuana). He was taken for a blood test.

My question is "how do they define if you were impaired or just have marijuana in your system?" He did tell me he had smoked earlier that day but was not "high' at the time he was driving.... Is there a concentration of marijuana in your system like the .08 % for alcohol???

Unlike some states, there is no per se limit for controlled substances in your system in Wisconsin. Any amount of a detectable controlled substance while driving is considered illegal.

The only defense to it would be if he had a valid prescription from a licensed physician for the substance.

I should also add the the original operating while intoxicated charge (i.e. impaired) would stem from factors such as his driving behavior and more importantly, his performance on the field sobriety tests.
