PA DUI - WV License First OffenseWhat is the name of your state? WV I have a WV license, but recently was cited for DUI in PA. I was advised by the officer that based on my clean history, I would get the PA - ARD program. I'm wondering if my "out of state" status will affect my sentencing as the ARD program seems Pennsylvania specific? An additional question I have is, How will WV handle the PA-ARD sentencing if I recieve that? Last edited by aFirstTimer; 04-16-2007 at 11:18 AM. Reason: additional question |

| Q: I'm wondering if my "out of state" status will affect my sentencing as the ARD program seems Pennsylvania specific? A: You committed the crime in Pennsylvania, so it will governed by Pennsylvania law.

| They set up ARD for out of state offenders all the time. Essentially, you'll meet with the Probation department in PA who will set up your general rules (stay out of trouble, no drinking, no drugs) and a time for you to report in (they'll usually let you do this by phone). Then (and this takes place slowly) your file will be transferred to your local probation department in WV. They will likely have their own set of rules. |

| As always every county is different, the best I can say is that you'll just have to wait and see. Your main requirements with ARD will be an alcohol evaluation, DUI school, and probably community service. |
