paternal DUI and maternal kidnappingWhat is the name of your state? AZ My boyfriend was arrested for DUI with his daughter in the car. He never went to court on it because no one knew what his blood alcohol level was. It was dropped but they can refile the charges. Now, two months later, his daughter's mom moved, the phone is no longer connected, and the house is empty. He doesn't know where his daughter is. She (mom) told him if he tries to see his daughter, she will file charges against him again. (She didn't drop charges, the prosecutor did). She told him his choices are to forget his kid, or go to prison for 2 years and not see her anyways. It was stupid and dangerous to drive with her (or without her) after a couple beers, but the legal punishment shouldn't be loss of his child forever, with no contact even by telephone. |

| She's just trying to scare him. What does she have to do with the DUI charges???? Nothing, that's what. Tell him to contact an attorney and pursue a court-ordered custody agreement.

| Absolutely, she has nothing to do with the DUI charge. Chances are if it was not filed to begin with, there was not sufficient evidence then, and probably isn't now. Now the mother could use the information in a civil action against him, showing his apparent disregard for his childs safety by driving under the influence. |
