Please HELP need adviseOk, Hi and thanks to whoever helps me with this problem I have put myself in. I got pulled over for my second DUI last night and im affraid of the consequences. I had a valid drivers license and got pulled over for following too close so the officer said. This is what I had to drink yesterday. I started drinking at 2pm, had 4 heinekens by 4pm, at 5:30 I had 2 more heinekens. Then didnt have another drink till around 8:10, after that I consumed 4 blue moons 20oz mugs at the bar. I got pulled over around 10:30pm. I took the sobriety tests and the officer said they had to draw blood from me. So they did that around 11:30pm. I live in Arizona and not sure what to do now. Im 6'2" and weigh 210 pounds. I have court in a week and they advised me I will get the results then. What should I do now? Do I have a chance to be below .08? I wasnt feeling drunk at all and I need some advise. If anyone can help me out with this it would be a huge help for me. Thx Robert. |

| No they advised me I would get the results on my court date. This barely happened last night. Got court on the 7th. |

| Is that my only option? I really cant afford an attorney. Do you think my bac will be below .08?..considering my weight and time? Why did they say I will get my results on my court date? is that legal for me not to know? |

| You had the equivalent of about 13 beers in 8 hours ... 9 1/2 hours by the time of the test, according to your figures. I would estimate your BAC to be about .09 - .11 at the time of the test given your size. Good luck. - Carl

| On the citation there is no BAC on it..Is this normal procedure? I dont know what to do...terrified out of my a**..excuse my language im just really dissapointed for making this mistake. |

Just wordingOur DUI's were not mistakes, my friend, they were examples of very poor judgment. I agree with Carl's estimate as to your BAC. That too, however, can vary depending on things like how long you've been at your drinking career. The very healthy body metabolizes alcohol at a certain rate, while one that has consumed booze for a long time can do so more slowly. You should note that the so-called "legal limit" is not the only factor needed for a successful prosecution for DUI.

| Carl is probably right with his estimation of your BAC. However, you could certainly go to court on the 7th for your arraingment without a lawyer. If you were over the limit and you are being charged, you could simply plead not guilty and hire a lawyer then. Or, the better idea would be to do an initial consultation with a lawyer (many will do it for free) to get their concurrence that this is a reasonable route to take. As for not being able to afford an attorney... don't be stupid. You can't afford NOT to hire an attorney. |
