Possible DUI


What is the name of your state? VA
Hello, i have a question about being pulled over by virginia police. I occasionaly have a couple a drinks at a friends house, and drive home. Im never drunk when i drive, but i could be close to VA's law of .08%. If i get pulled over what is the best advice if i think im close to .08 (like refuse the breath analyzer, but do the field check, refuse to talk to the cop at all, etc) I know the best advice would be to wait it off, but just would like to hear the legal side of it.

In general


you should refuse the field test, but take the breathlyzer. Most states have an automatic license suspension for refusing the breath test. And some states now are making it a crime to refuse the breath test with it's own penalties.

I don't know why they do the field test anyway. It's really a moot point. If you're pulled over under DUI suspicion, the officer has already decided there's going to be an arrest, and he or she willl find a justification for it.

**A: before you get pulled over, drive as fast as you can to get away since you need the extra time to recover. Then when you finally get stopped, you will pass the dui field tests with flying colors.
