possible dui?


What is the name of your state? MT

Situation: Backed into two cars in an icy, snowy parking lot, stepped out of car and talked with a security guard, gave my license and insurance to security, when he walked off, i drove off, he called the highway patrol to file a report, his report stated that i was very drunk and slurring my speech, and that there was a beer can in the car. No tests, or breathalizers or anything of the sort were taken, nor did i speak with a cop on the scene, would this be enough evidence in court to convict me of a dui?

A: There is about a 50-50 chance, more or less.

Sounds pretty weak, since no arrest was made nor even a cop spoke with you following the report. Chalk it up to very good luck on YOUR part. Keep in mind, it's almost inevitable that you'll get caught for DUI one day, if you drink and drive.

If the security guard presses you, just remind him how happy he should be for the people he is protecting that you even carry car insurance, I've learned that it's a commodity in my state!. Tell him otherwise to blow it out his ass, if he wants to be a REAL cop, go back and get his GED and find some police force to hire him and send him to the academy. Security guards all have ego problems. Tell him to call his "friends" downtown and see what can come of his accusations. Because that's all they are, accusations. They don't hold up and neither will this case because no arrests, reports, or any legal action was taken. Someone, a law enforcement representative, would have to legally prove you were intoxicated. QED
