Possible DWI related warrant in NM


What is the name of your state? NM

I received a DWI in January of 2004 in NM. I served only 3 days in jail, and was released on my own recognisance, and placed on probation until May of 2005. I completed all of the court ordered classes and community service before schedule, with the exception of 2 of 10 "substance abuse counseling" sessions which I had planned on completing, but the counselor kept cancelling my appointments and I couldn't afford any more time off of work. I tried calling them several times to set appointments, but their phone system was all out of whack and kept looping me back to the "You have reached the...." message.

To make a long story short, I moved to CO in late July 2005, and was going through my paperwork the other day and found that, not only did I not complete those 2 classes, I also still have my timesheets from the community service (which means I missed a probation meeting). I'm afraid that I might have a warrant out for my arrest now, and don't know what to do. I think I might be able to complete the 2 sessions over the phone (if the counselor will allow it), but I would like for the court situation to be resolved as well. Does anyone have any suggestions?

Thank you for the response. I want to be completely honest with the state/court and go see them before they "come see me" (I'm not even sure there IS a warrant out...I'm just afraid that, given my not having completed the last few sessions, there will be). I'm afraid of having any sort of further sentencing though. If I come into compliance with all of the terms of my probation (which technically ended in May of last year), is it likely that there will be further prosecution (if that is the right word)? I admit that it was complete negligence on my part....not having kept my appointments and such in order. But being so close to completion... I'm just scared.

You have to go to the court, ask them if there are any warrants on your case and ask them to schedule the case for court, if there are.

As SJ said, surrender. Nobody can say what the outcome will be - it is up to that Judge.
