Probation in Nj, recent charge in PA


What is the name of your state? NJ

OK i live in Nj and i am on probation since june of 04 - june of 06 for prossesion and intent of drugs. Just recently (saturday night), i was at a friends house in PA and the cops came and gave all of us summons for "purchase, comsumption, possession of transportation of liquor or malt or brewed beverage" Im not sure if this is an underage drinking charge being that i am only 20 an di failed a PBT.

So what i am asking is, well this summons transfer over in any way or get back to my probation officer, being that this was issued in pa and i live in nj?

is there anyway i can get this dropped to something lesser? what are my options?

My response:

None. Your P.O. has a computer. Your P.O. will find your arrest and your eventual conviction - - especially since you won't be showing up in N.J. because you'll be behind bars in P.A. Then, you'll be busted for your conviction and get to spend the rest of your probation behind bars in N.J.

u may be correct, but thats ur opion, i would appreciate some more factual information.

I was reading up and supposedly a summary offenses is not entered into NCIC or CLEAN (Commonwealth Law Enforcement Assistance Network) for the purposes of criminal histories. So if this is true than i would not be in trouble.

can anyone varify this about an underage drinking summons in pa being put on some sort of network making it accesible for Nj to see?

First of all, IAAL may be rough around the edges with his bed side manner, but you got a response from an attorney.I really don't think you are going to get much help with this issue. You can't even form a sentence without mispelling everything that you write. You are now trying to give other posters wrong advice.

The charge you received in PA is our underage drinking statute.

You are correct that this will not be entered upon your criminal history as it is a summary offense, however it carries a driver's license suspension which will likely by honored by NJ, thus suspending your NJ driver's license.

I'd suggest coming clean with your PO. There are many ways he/she may discover this citation, and you would be better off being honest than getting caught being deceptive.

Thanks Bravo, what exactly is this ARD program and who qualifies for it? WOuld i qualify being that it is my first underage drinking offense, but i do have felonys in NJ, would they look at ur NJ background when determining this??

There is no ARD (Accelerated Rehabilitative Disposition) available for underage drinking, as it's a summary offense.
