probation violation on 3rd DWI


What is the name of your state (only U.S. law)? Texas

My boyfriend recently was arrested on his 3rd DWI while on probation for another charge. He is now serving time in jail until he has a trial. Does anyone know what his likely sentence would be for this? Will he likely do alot of time for this?

depends on the charge he was on probation for. that charge will have terms for his probation. he will have to serve his original sentence, throw on top of that his probation violation, then charges for his third DWI. it's not looking pretty.

his previous charge he was doing probation for burgulary of a habitation with the intent to commit a felony.

Well that burglary would be a first degree felony then which carries a minimum punishment of 5 years in prison. Its pretty unlikely that his probation would be reinstated unless this new Felony DWI has very poor evidence. So I'd say he is looking at a bare minimum of 5 years TDCJ, which is a long time in my book.

He's looking at up to 10 years on the DWI but up to 99 years or life on the burglary.
