Public Intoxication of a minor in CaliforniaMarin County, California I'm 18 years old, I recently got picked up on the 4th of July walking home from my friends house pretty drunk. Spent the night in the drunk tank, and have a court date coming up. I'm unsure how to go about it, I've heard I should plead no contest. What I'm really trying for is a diversion, though. I've never had a problem with the law before, but the charge I have is a 647 (F) PC. Now, I've read online that the PC part means I was a hazard compared to everyone else, so that makes the charge worse. Does anyone know what my chances are of getting a diversion, or what will likely happen to me? Thanks. |

| Many counties in CA will resolve the matter without prosecution. Others will likely have a deferral program of some sort that will allow you to go to counseling, be on probation for a year or two, and then dismiss the whol ematter if you stay clean. What your county will do is something I do not know. It would be in your best interest to at least consult with an attorney and find out what the ramifications of a guilty (or, no contest) plea might be. - Carl
