Question regarding my case.

Hello, I am a 21 yr old from Tx, and was recently involved in an accident which unfortunately also included a fatality. Though I had been drinking earlier in the day I left the scene thinking someone had thrown something at my car, and was later arrested for leaving the scene of a crime, I think.
My question may be kind of awkward but I was looking for some opinions, I do have an attorney but was wondering if I could get some opinions from someone elses point of view. The person who died had been in the road all day, and apparently was either trying to committ suicide or was mentally unstable. Though I by no means condone drinking and driving I believe that is complete irrelevant to the accident. I was wondering should I be expecting some jail time, and if prior arrests would have anything to do if in fact it does go to trial.

Here are some facts about the incident.

-was in the outside lane
-did not have time to swerve, no skid marks
-all witnesses said it was unavoidable
-police were on their way to pick up the victim from reports of the person being in the road
-out of the 3 oncoming cars 2 had there brights on, 1st and final car to pass
-4 prior alcohol related tickets.

Please be decent with your replies. I'm looking for some intellectual answers don't need any lectures or snide remarks. Thank you very much.

C.

No one can answer that since there are simply too many unknowns. My opinion is, yes, you should expect some 'jail time'....

Yes.

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

Ditto what JetX said.

Your flight from the scene will also be used against you as consciousness of guilt.

You are not in a good place.

Why did you leave the scene and did you know someone had been killed? From your post is does sound like you may have known it was a major incident... If you hit something or someone - Turning around at the next exit should be a priority - Better yet, never leaving the scene.

And recently in Dallas there was a wreck on 183 that left a part of the road / overpass inpassible - A DUI case - Killed the driver of the semi, drunk dude walked away.

Sounds like you had a major accident with a fatality - Why would you think it's okay to leave? You also have knowledge of the person who was killed somehow.

Even if he was suicidal, it's not your place to end his life by your car, and walk away.

You're in for some jail time and, quite frankly, it's what you deserve. How would you feel if it were one of your loved ones who were killed? Nobody ever wants to take responsibility for their actions.

I can't believe you had the audasity to say that. That's not even what I was implying smart one. I simply wanted to know the facts. It's not that I don't want to take responsibility, but you imagine had it been you in the drivers seat. I feel horrible enough as it is, and as I said don't need any snide remarks. Thank you anyways.
