Question

Recieved DUI in NJ had DUI in PA 9yr ago


What is the name of your state?NJ
I was ticketed for a DUI in NJ . I had a DUI 9 yrs ago in PA . It was expunged from my record. Will this effect me now in NJ? I wondered if this will be considered my first offense. NJ considers a second offense if it happens within 10yrs and PA is if it happens within 7 yrs . Will it still be on my DMV record in PA? Help please I am a Nurse and if convicted of second DUI I am afraid of what effect this will have on my career.

Get your driving record from PA; that will answer your questions.

If it still shows, then this will be a second in NJ because you go by the laws of the state where you were arrested.

Why in the world are you getting a second DUI??? Do you like getting your life destoryed or what??

Thank you seniorjudge I checked and I was 30 days shy of the 1st offense in PA being 10yrs ago. So I guess now i am looking at a second offense. Will I have to go to jail? My dad told me not to get lawyer but he does not know about the first dui in PA. I am very scared about what is going to happen to me. I don't know how the process works also I want to know if I will lose my nursing license?

Just FYI....PA now considers a first offense as occuring in the 10 years prior, not 7. They changed it in February 2004.

I can't comment on whether NJ will count the PA offense as a first offense for their purposes. A competent NJ lawyer should be able to nswer that better.
