refused chemical test. automatic suspension?


What is the name of your state? Indiana

I was Arrested for OWI. i refused to take the breathilizer test. so i spent 24 hours in the tank. The following monday i went to pre tial and No charges have been filed and they said "no news is good new".

I got a receipt for my license that says:

" This receipt is issued pursuant to IC 9-30-6-7 and is vaild until your driving privileges are suspended by the court or by bureau of Motor Vehicles. Notice of suspension will be sent to the address you have provided to the arresting officer> If your driving privilege is already suspended when you receive this receipt you may not drive. YOU MUST BRING THIS RECEIPT WITH YOU TO COURT.".

It's been close to 4 months and no word so i've been driving on it for a whlie. Does automatic suspension apply even if i am not charged with anything? what is going on? thanks.....

Why are you asking us on this forum? Did you think that if you called the DMV and/or the court, one of them or both of them would reach through the telephone lines and grab you by the throat?

C'mon, get with the program, will ya?

You will hear from them, they just take their good old sweet time about it.

Indiana does have an implied consent law, if you refuse the tests, you do have an automatic suspension.

Sorry, just ignore him. He got banned from the board, and has since totally lost it, he is now acting like a spoiled little brat who had his favorite toy taken away.

Suspension


I am assuming that this is not your first rodeo since you decided to decline the breath test. When I lived in Indiana some years ago, the third OWI was considered a felony...You may want to see a lawyer.

Please note that the refusal to take the test is a whole different issue than being charged for OWI. They do not need not need the test results to charge you. Sometimes the DA can even get a conviction using the video shot from the police car and your roadside coordination test. You are assuming that you were not charged, but if it were me I would check. In his own twisted way IAAL was trying to tell you to call and find out.
