resolution of dui plea agreementWhat is the name of your state?California/Louisiana. My "friend" had a California Driver's license and was residing in California when he received a DUI there. He subsequently plead no contest as part of a plea arrangement. He then moved to Louisiana and had his Louisiana Driver's license reinstated in that state without satisfying any terms of his California plea arrangement. His Louisiana license has since been suspended due to him not satisfying the California terms and he has attempted to contact the California D.A.'s office that prosecuted his case, Department Of Motor Vehicles etc. to satisy his obligations so that the hold will be lifted off his Louisiana Driver's license. However, the California D.A.'s office "insists" that he will have to appear on the bench warrant that has been issued for him. The warrant was apparently issued due to his failure to satisfy the financial terms of his probation as well as the mandatory classes and "community service". My friend wants to pay his debt to society and has since served as a Police Officer as well as a Social Worker but it seems extreme for him to have to appear in a court preceding a few thousand miles away to do so. Does he have any other options? |

| Yes, he has another option - retain an attorney in CA. He may still have to appear, but he can minimize this thorugh the use of an attorney. And if he managed to work in LA as a peace officer while he had an outstanding warrant in CA, then I am appalled at the shoddy background checks performed by that particular agency! I HOPE that it is not indicative of law enforcement standards and practices state wide there ... though I have heard stories. - Carl

WellHe's gotten himself in to quite a predicament. It's sounds like he moved to Lousiana without notifying or getting approval from the court and his probation department. On top of that, he didn't pay his fines, complete alchohol school or complete the community service. That's a quadruple wammy, and I'm suprized the warrant is only bench level. Hindsight is 20/20, but he should have completed these things before relocating. But it gets tougher. I believe in most states, the alchohol school has to be completed with an agency that's state certified in the state the offense was committed. He'll have to check with them and see if they'll accept alchohol school from a Lousiana state certified agency. I think the states do accept community service done in another state, and of course they'll be happy to take the fine money any way he can pay it. If I were him, I'd get going on the community service and get the fine money sent in. I'd be suprized if he can clear this up without a trip to CA on the warrant and possilbly a few days in jail, but maybe a CA attorney can work something out. Have an attorney find out what to expect. If there is going to be jail, he could go in early before court and get some or all of it done. That way, you clear it up in one trip. |
