Restoring Driving Privileges


What is the name of your state? North Carolina
Hello,
I was arrested for DUI in July 2004 and promptly had my license suspended for 30 days pending a DMV hearing. After the DMV hearing my license was suspended for 1 year starting Nov 2004. In May 2005 I plead no contest and the judge then ordered my license suspended for a period of 1 year starting in May 2005. My question is how do I get my license back? Can I petition the DMV or the court for a provisional with limited privileges? If so when am I eligible to do so?

Call your DMV and check it out. You can ask questions without telling them who you are. Here in Florida, it works like this. DMV and court are two different entities. License suspension is the longer period of the two. But, you can apply for a hearing to get a "hardship" license after a certain period. Here it's 30 days if you took the breath test, 90 days if you refused. That follows the ten day interim period AFTER the arrest, during which you get to use your copy of the citation for ten days. So you add 10 plus either 30 or 90, depending on whether or not you too the tests, before you can apply for hardship license.

I too found it confusing, thus my call to DMV. It took awhile to get to the right person, but then they made it all quite clear. Be prepared when you go to the hearing. They may ask you what you've learned, how you will prevent repeating this behavior, and what your driving needs will be. You can also be denied if they so deem it, so look the part and try to be respectful. DMV has broad authority in this area. For me, this was an all day affair too. Hearing in one place, then off to another to get the license.

You get your license back when you learn to be responsible. Too bad the court didn't realize that was a period longer than a year in this particular case.
