| BigMistakeFl Call your DMV and check it out. You can ask questions without telling them who you are. Here in Florida, it works like this. DMV and court are two different entities. License suspension is the longer period of the two. But, you can apply for a hearing to get a "hardship" license after a certain period. Here it's 30 days if you took the breath test, 90 days if you refused. That follows the ten day interim period AFTER the arrest, during which you get to use your copy of the citation for ten days. So you add 10 plus either 30 or 90, depending on whether or not you too the tests, before you can apply for hardship license.
I too found it confusing, thus my call to DMV. It took awhile to get to the right person, but then they made it all quite clear. Be prepared when you go to the hearing. They may ask you what you've learned, how you will prevent repeating this behavior, and what your driving needs will be. You can also be denied if they so deem it, so look the part and try to be respectful. DMV has broad authority in this area. For me, this was an all day affair too. Hearing in one place, then off to another to get the license. |
