restricted license:Clarification pleaseWhat is the name of your state? CA Well i went to court again today to turn in my 30 meetings for my MIP and to petition for a restricted license. The court OK'd my restricted license but the judge told me to check with the DMV to see if i can get it. This is were I am confused. Here is some information: CVC23140 -minors DUI as I have been told - dismissed on furtherance of justice B&P 25662 - 30 AA meetings - these meetings have been completed ( i believe this dismisses this charge). Mandatory 4 month DMV suspension for being CITED with a DUI. 10 months left on my court suspension. Now since I was granted the restricted permit I should be able to apply for a drivers license at the DMV and pay the reinstatement fee of 125 and be done. I was talking to some DMV officials and they were saying that I might need to carry an SR-22. I thought you have to carry these only if you are convicted? Also about insurance, If on my drivers record it shows that I had a 23140 and MIP but they were both dismissed, is that still grounds for hiking rates up to extreme measures? I could see that its reasonable, buuut i was hanging on to some fleeting hope that because they were dismissed it means differently. One more thing...A lady at the traffic window of the court said that those two charges (MIP & 23140) show up as convictions but they are DISMISSED and that they will show when trying to get a new job. However, she said I could come back in a year and try to get them exspunged (sp). How does exspungment (sp) work? I swear every time I go to court I come out even more confused and led in 20 different directions. Some DMV lady told me to call Sacramento!! Well thanks again guys for helping me through my struggles. |

| If you have a non-commercial driver license and you show proof of enrollment in a DUI treatment program, file proof of financial responsibility and pay a $125 reissue fee after a mandatory 30-day suspension, you may request a restricted license to drive to and from the DUI treatment program and/or to, from, and during work. The reissue fee remains at $100 if you were under age 21 and were suspended under the Zero Tolerance Law pursuant to Vehicle Code §§23136, 13353.1, 13388, 13392. The SR22 is the proof of financial responsibility that you need to keep on file. BigMistakeFlI think that you need to secure SR22 insurance only if you did not have coverage at the time of your arrest. Correct me if I'm wrong. With regard to figuring out the suspension, "hardship" license, etc, I ran into the same conflicting information. I was finally steered correctly to search and find the telephone number for my state's DMV Administrative center. Once I called and actually got through to that very busy number and reached a human, she was able to set the record straight and told me exactly what I had to to, and when I was eligible. My advice is to keep trying to get to the right part of the DMV. |

| That's great news about the sr-22 but I have heard differently so I'm still worried. Yeah I will probably end up callin sacramento or something |

You are wrong. I don't sell insurance, undecided, sorry if I gave you that impression. But I do know if your father's insurance is thinking of dropping you and therefore will not "sell" you an SR22 under the current policy you need to do some insurance shopping. (Ouch) You need to show coverage, an SR22 filed and then make your way over to your local DMV to stand in line to get your restricted license. It does not matter if you were convicted or not of any of the wonderful VC numbers that you now seem to know by heart. Your license was suspended and you still need to go through all these steps to get it back. Keep jumping through those hoops.

BigMistakeFlOk, could be different in each state. I stand corrected. I only know that here in Florida, I did not have to take out an SR22 policy. When I asked the DMV, they told me that as long as I had full coverage at the time of the arrest, I was good to go. I did get my "hardship" license and have since gotten my regular license back without SR22. |

| i might as well give those people in sacramento a call... Its worth a shot. Just finished finals so i have some time to sit around waiting for the next available person to help me. haha thanks guys. |
