someone is trying to tell me they will treat this dui with first offense penalties because I was underage at the time of first one. this sounds far fetched. does anyone have any info on this?

It is far fetched. As far as priors go, 18 is the age you become an adult. Not going to argue why the alcohol consumption laws pin it at 21.
