Question

statue of limitations on dwi


What is the name of your state? louisiana
i was charged with dwi on sept. 21, 2002. i took urin test and for months i called da's office to find out the results.they still havent done test yet and told me not to come to court till i was served papers. now it been a year and never been to arrianment. what if anything can be done to me about this?can they now serve me with papers for court?

I do not know what the statute is in your state but in Kansas it is or was 2 years. In fact I have a friend that got one 3 years ago and 2 months before his 2 years was up they called him into court. Also you stated you haven't heard the results of your test. If this is still the case you might want to call up driver control (DMV) in your state to see what is on your license (they should go back 3 or 5 years). Even if you do not have the results they will and you might unknowingly be driving with a suspended license. Of course when you call do not tell them you were stopped for d.u.i. just ask them what is on your driving record. If they say nothing then it probably means you passed the test and have nothing to worry about. If they say you failed an alcohol test Sept/Oct of 2002 then you might want to get ready to go to court.

According to the LA CCCP:
"Art. 572. Limitation of prosecution of noncapital offenses

Except as provided in Articles 571 and 571.1, no person shall be prosecuted, tried, or punished for an offense not punishable by death or life imprisonment, unless the prosecution is instituted within the following periods of time after the offense has been committed:

(1) Six years, for a felony necessarily punishable by imprisonment at hard labor;

(2) Four years, for a felony not necessarily punishable by imprisonment at hard labor;

(3) Two years, for a misdemeanor punishable by a fine or imprisonment or both; or

(4) Six months, for a misdemeanor punishable only by a fine or forfeiture."

So, what was the EXACT crime you were charged with and how many previous charges??

There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution).

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

thank u so much for reply. and as far as my urin sample it still at crime lab. has never come up for testing. i have learned my lesson. thank God!
