Is time a factor?


What is the name of your state (only U.S. law)? missouri
I have had 4 dui, the last one in 1994 or 1995. I have spent years in prison and I'm just now starting to get my life back on track. I've paid all the fines that kept me from getting a drivers license, but ever time they come up with something else I have to pay. A new law just went into effect in July, that makes multible dui's put a breath test machine on my car for 6 months. The4se new penelties weren't in eefect when I got my tickets. Do I still have to do them after all these years?What is the name of your state (only U.S. law)?

Yes, they can change the rules to get a driver's license. You'll have to get the interlock. This isn't part of your "penalty."

sounds like you need it anyway....you should have been banned from ever driving again..

people come here for advice.. yes they get ripped on but they seek advice.. atleast offer some advice on the matter instead of only a personal judgement that has zero barring on the issue.

This is happening more and more and will continue as laws change to prevent DUI recivitism. Hopefully for multiple offenders, this will work. Time will tell.

If this was an actual law, then I would say it can't be enforced retroactively. That is unconstitutional.

I am not defending drunk driving - I wish the penalties were more severe. But ex post facto laws are specifically prohibited by the United States Constitution.

An ex post facto law (which is barred by the Constitution) keeps them from enacting a law AFTER you do something to make it illegal. This isn't that. They changed the rules for obtaining a license to make it more adverse for one class of people (habitual drunk drivers) and that's not unconstitutional as long as it's not targeted against an individual or a protected class of people.
