Time limits for DUI

My 19 yr old son slid off the road last winter. No damage but stuck in ditch. Hours later, state patrol showed up in response to passerby calling in accident. The kids had given up getting out of the ditch and drank some beers. Son blew an 0.09. Agreed to plead to MIP but pros atty said Reckless. Son said no so they are going for DUI. No police observation of driving or physical control and no witnesses to that. True of not, son's friends say he was DD and only drank after accident. It has been 10 months now of pre-trial, jury selection, etc. but now another delay by prosecutor. How long do they have to bring this thing to trial? Thanks for any help you can give.

They got a lot of time yet. I think their hoping for a guilty plea ahead of time. DON'T go for it. From what I have read, they have nothing
