traffic violation on probation


California
Just got a traffic violation for driving at 80 mph. I'm on a 4 year probation for a DUI I got last year. The condition on my probation was to "obey all laws". I suppose I disobeyed the traffic law and it'll cost me a lot more than a speeding ticket. The question is - does anybody know exactly how harsh can the punishment be?

A fine only. I seriously doubt that your probation will be violated ... unless a condition of probation was not to drive or your license was suspended.

Technically, you have violated your probation and the judge could throw the book at you.

Carl, however, knows how the courts work out there. For your sake, you should hope he is right in this instance.

**A: what was the posted speed limit at the time of the infraction and did this occur in a school zone?

If he was simply cited for simple unsafe speed, I cannot imagine a probation department fighting to put him into jail. With budgets being what they are, he'd have to commit a non-traffic misdemeanor or better to get tosed into the clink ... MAYBE driving on a suspended would do it, but that would depend on the county ... and few would.

Thank you so much for all the info. The posted speed was 65 on freeway where everyone drives 75 and 80, but I happened to be the only car on the road at that time (around 5.30 pm so go figure), and I guess the officer just saw easy prey in me. Anyhow, I'm really glad it won't count as a violation of probation, I am feeling much better now.

so did you find out wheter you violated you prbation or not!!
